The new Army manual, known as ATP 3-39.33, provides discussion and techniques about civil disturbances and crowd control operations that occur in the continental United States (CONUS) and outside the continental United States (OCONUS). 

This document, just published this past Friday, August 15, 2014, promises to change the way the “authorities” deal with protesters, even peaceful ones. The consequences of ATP 39.33 could prove deadly for protesters. Further, the provisions of this Army manual could prove to be the end of the First Amendment right to peaceably assemble.

On August 15, 2014, the U.S. Army published and released the Army-Civil Disturbances Manual-2014. The contents are frightening and should be offensive to American citizen.

 

In section 1-2., the manual states that  “Civil unrest may range from simple, nonviolent protests that address specific issues, to events that turn into full-scale riots“. This section of the manual clearly states that protesting is a right protected by the Constitution. However, the authorities leave themselves an out to “legally” engage in lethal force toward protesters when the manual states that “peaceful protests can turn into full-scale riots” and field commanders have the right to make that determination. Subsequently, all protests, peaceful or not, need to be managed by the potential for violence. In other words, all protests are to be considered to be violent and handled accordingly. This certainly explains the violent manhandling of the media by the DHS controlled and militarized police in Ferguson, MO.

Posse Comitatus Is Violated

On the surface, the Posse Comitatus Act (18 USC 1385) act should prevent the Army from deploying the troops in the midst of a protest that is not on the scale of something like the 1992 LA Riots. However, the Army claims exemption from Posse Comitatus in the four following areas. 

  • 10 USC 331. When a state is unable to control domestic violence and they have requested federal assistance, the use of the militia or Armed Forces is authorized.

  • 10 USC 332. When ordinary enforcement means are unworkable due to unlawful obstructions or rebellion against the authority of the United States, use of the militia or Armed Forces is authorized.

  • 10 USC 333. When a state cannot or will not protect the constitutional rights of the citizens, due to domestic violence or conspiracy to hinder execution of State or Federal law, the use of the militia or Armed Forces is authorized.

  • House Joint Resolution 1292. This resolution directs all departments of the U.S. government, upon request of the Secret Service, to assist in carrying out its statutory duties to protect government officials and major political candidates from physical harm.

 

With regard to 10 USC 331, if the local authorities have lost control in the midst of a profound display of domestic violence (e.g. LA Riots), most Americans support the use of National Guard or the military.  However, in 10 USC 332, 333 and House Joint Resolution 1292 are ripe with exceptions which opens the door to federal authorities abusing the public for exercising their Constitutional right to protest.

In 10 USC 332, the phrase “unlawful obstructions or rebellion against the authority of the United States, use of the militia or Armed Forces is authorized”  and this permits the federal government from being demonstrated against. An act of demonstration, or the most benign demonstrations of civil disobedience gives the government the authority to take “deadly action” against the public  because there are no clear distinctions on when the use of lethal and nonlethal force is appropriate (see the two charts displayed below).

In 10 USC 333, any disruption of federal law can be decisively dealt with by the federal government. The phrase “…conspiracy to hinder execution of State or Federal law, the use of the militia or Armed Forces is authorized” is a telling passage of this Army document. If 10 USC 333 is applied to the letter of the written Army policy, the protesters who recently objected to illegal aliens being deposited in Murietta, California, could be subject to deadly force. Further, the protesters in Ferguson could be subject to the use of lethal force as well (Again, see the charts below).

The next time a community decides that it does not want to accept illegal immigrants, or protest the shooting of an unarmed 18 year old,  they could be met by the following:

“I feel threatened. No more protests”.

 

The fourth exception claimed by the Army with regard to the Army’s right to violate Posse Comitatus, is presented to the American people under the veil of the need to protect politicians.

House Resolution 1292 claims any protest which makes a public official feel “threatened” would be illegal and subject to intervention by the U.S. Army. Hypothetically, if 100 protesters were to gather outside of Senator John McCain’s office in Phoenix, would that be enough to trigger a violent response by the Army? If McCain says he feels threatened, regardless if his claims are legitimate or not, it most certainly would justify the strongest response possible from the Army. Therefore, all a politician has to do is to say they feel threatened by any gathering to have the gathering dispersed and the protesters dealt with in any manner seen fit by the field commander. Make no mistake about it, this is the end of the First Amendment’s right peaceably assemble.

Do you remember the uproar when DHS was caught distributing target practicing sheets of pregnant women to be used for DHS agents when they were engaged in target practicing?

And of course, I am certain that you recall the use of an elderly person’s image to be used by DHS agents for the same purpose. The implication is clear; The American people are the new terrorists.

The second chart is a sample guideline on when the application of lethal force is appropriate to be applied to protesters. Please note the ambiguity with regard to the application of lethal force. It is also noteworthy to point out that the following chart provides for the planned use of snipers to target the perceived leaders of a protest. These procedures remind one of the events in Kiev prior to the ouster of the Russian-friendly Prime Minister. It would appear that CIA agents were beta testing these procedures in Kiev prior to the coup.

Conclusion

 ATP 39.33 is quite clear in its intent which is to eliminate the act of protesting from the American landscape. More disturbingly, the right to summarily execute peaceful protesters is contained in this Army manual due to the purposeful ambiguity of when it is appropriate to use deadly force against protesters.This Army manual is an example of hard core, in-your-face martial law befitting the most violent regimes in the history of the planet.

There is another message contained in ATP 39.33 and that is the clear anticipation that the American people are going to feel the need to be protesting in earnest in the foreseeable future. What exactly are the American people going to feel compelled to protest that remains unspecified in this manual? Could it be resistance to mandatory Ebola vaccinations? Could we be looking at food riots in the future? Will it be a currency collapse that puts Americans in the street? Will America rise up and say no to the plans for World War III and the coming conscription of both potential military personnel and a civilian labor slave force as described under Executive Order 13603?

Not only should this document be a frightening wake-up call for all Americans, it should also serve as a warning for what is to come.

    I have a very simple solution for this: STOP ENCOURAGING YOUR CHILDREN TO JOIN THE MILITARY! As long as there is a supply of young people walking into enlistment centers then this kind of thing will continue. Anyone who permits their child to enlist is an accessory before the fact.

    Keep this in mind… Our military has 180k men under arms. That’s right, go add it up, 180k and they are scattered thoughout the world. That number is actually lower because it is before sequestation cuts and it includes the coast guard which is no longer part of the military, the are now fully under DHS.

    Secondly, I am not convinced, in fact I am skeptical that most of the military would go along with this. I honestly believe most of them, the guys with the find anyway, will side with the people against the gov.

    In support of this, the gov does not trust them to be on their side either. That is exactly why they have militarized the police (who will do the governments bidding) and created DHS.

    DHS has 250k men under arms. Do you realize that? More than our entire military!

    In any case, 1% of our population willing to fight outnumbers them three to one and that includes our entire military, the DHS and every single cop (federal, state and local) in the nation.

    We have the numbers. We have the weapons, low tech beats high tech every time. They know this and that is why they have not made their move yet, they are afraid of us.

    Be ready, the time will come. We have that 1% easily and that is just the guys willing to do what it takes to win. It won’t be pretty. Be ready!

    Mr. Hodges…..My interpretation of these new guidelines is that the military can act as policemen now….We all get that…But, does DOD have the authorization to grant militia status to other Federal Forces?….Could the Secretary of Defense, on order or without order of the POTUS, grant militia powers to say, DHS?…Whereby authorizing deadly force against protesters? If the new militia were granted said status by the Dept. of the Army, would they receive the new handbook?….What about the BLM? Could they be granted militia status? If so, Cliven Bundy better watch his back side…

    This recent army manual takes yet another step toward normalizing practices of absolute dictatorship. It would be well for protocols of response to be developed by patriotic Americans. The use of agents provocateurs will likely become standard procedure. Hence, it is essential that people prepare beforehand to document as much as possible the identity of these operatives. Photos, videos, anecdotal facts of their activities must be made public far and wide. It was heartening to see the people of Ferguson continue to protest peaceably after the police attacked them. However, the countering imposition of curfews is the shutting down of expression and association. Information about deliberate actions of provocation on the part of the police under the auspices of D.H.S. must be made available to the people of Ferguson and all of America by every means possible. As well, people need to be informed of deliberate acts of incitement with the wrongful aim of shutting down protest, while paying lip-service to it.

    Groups could begin to practise protocols. Some could play protesters and others could pretend to act as vandals. They could be captured on video and camera and channels could be made ready to disseminate this material, with brief reports, as preparation for the real thing.

    There will still have to be (likely covert) means of taking back power. Ideally, sprawling computer facilities of control can be partly disabled by totally legal means. Of course, this and other initiatives can be taken more readily, while money, materials and fuel are still available.

    Also, it possible that through the use of Manchurian candidates or microwave manipulation, some lethal shootings or other violent actions by police officers are not within their control and that they are being utilized to foment serious unrest, leading to martial law preparations?

    Is it possible to quietly identify institutions that are doing covert MKULTRA experimentation and to find sources who would leak information? Some hospitals may be using children who suffer from epilepsy as non-consensual experiments for removal of brain tissue without consent or implantation.

    Civil disobedience only works during stage 1 Bismarkianism. In stage 2, Bismarkianism shifts to delay and retry or otherwise under darkness. In stage 3, Bismarkianists don’t give a hoot as evident by the bailouts, bail-ins, ACA, NDAA, and etc as this is the Command and Control Power-Structure stage prior to Authoritarian Police State aka martial law roll out.
    This manual perfectly states that we’re transitioning from Stage 3 Bismarkianism to Command and Control roll out.
    The Power-structure does not want to see the populace form a counter-regency or otherwise counter-momentum or even the populace utilizing legitimacy and wield the domestic balance of power.
    On the bright side, everyone seems content to live in a Cashless-Paperless Society as if that somehow limits the Authoritarian Governance of the Command and Control Power-Structure…

    ‘They’ weren’t just making all these preparations for a police state slash military dictatorship for the heck of it, just because they could. It always has been their intention to use it.

    Operation Gardenplot, REX84, FM 3-39.40; it was all done for a reason.

    Disassembling the US Constitution and the Posse Comitatus were crucial in stripping the American citizens of their lawful protection against tyranny from their own government. Unleashing all that high tech surveillance was imperative to document all hostile domestic entities. Implementing the NDAA was essential to ensure the effective neutralization of dissent.

    Now you Americans will suffer the consequences. Your precious 2nd Amendment isn’t going to save you now: the authorities will come PREPARED.

    I think that the people should start asking the question, where is the constitution? Town halls, online, and in public forums the question should be asked, and an answer demanded. The article shows explicit treason, clearly outlined in the Constitution, yet no one asks, where is the constitution? So many issues of our day could be resolved by simply enforcing the Constitutional guarantees provided by our forefathers. No one can answer the question, and so few are asking, while treason takes a foothold, our leaders under the control of foreign bankers, doing their bidding, while Wall Street loots the public purse, no military instructions there to kill, murder, or maim, only the public whose cries are often justified are targets, no tanks on wall street, no military gear at all, only on downtown USA to keep the cattle under control the looting, the treason, the violations of our pact and contract called the constitution, yet no one asks, where is the constitution?

This certainly explains the violent manhandling of the media by the DHS controlled and militarized police in Ferguson, MO. – Posse Comitatus Is Violated On the surface, the Posse Comitatus Act (18 USC 1385) act should prevent the Army from deploying the troops in the midst of a protest that is not on the scale of something like the 1992 LA Riots. However, the Army claims exemption from Posse Comitatus in the four following areas.  – * 10 USC 331. When a state is unable to control domestic violence and they have requested federal assistance, the use of the militia or Armed Forces is authorized. – * 10 USC 332. When ordinary enforcement means are unworkable due to unlawful obstructions or rebellion against the authority of the United States, use of the militia or Armed Forces is authorized. – * 10 USC 333. When a state cannot or will not protect the constitutional rights of the citizens, due to domestic violence or conspiracy to hinder execution of State or Federal law, the use of the militia or Armed Forces is authorized. – * House Joint Resolution 1292. This resolution directs all departments of the U.S. government, upon request of the Secret Service, to assist in carrying out its statutory duties to protect government officials and major political candidates from physical harm. – With regard to 10 USC 331, if the local authorities have lost control in the midst of a profound display of domestic violence (e.g. LA Riots), most Americans support the use of National Guard or the military.  However, in 10 USC 332, 333 and House Joint Resolution 1292 are ripe with exceptions which opens the door to federal authorities abusing the public for exercising their Constitutional right to protest. – In 10 USC 332, the phrase “unlawful obstructions or rebellion against the authority of the United States, use of the militia or Armed Forces is authorized”  and this permits the federal government from being demonstrated against. An act of demonstration, or the most benign demonstrations of civil disobedience gives the government the authority to take “deadly action” against the public  because there are no clear distinctions on when the use of lethal and nonlethal force is appropriate (see the two charts displayed below).  – read more!     If I recall correctly, psychiatric makes normal at 67%. As a parallel, if 67% accept GMO foods, you must be part of the 67% to be considered ‘normal’.

    As for conspiracy, lets get the word usage down:
    Conspiracy is when 2 or more people come together to form a plot. When this plot consists of targeting a foreign nation by another, it is more appropriately referred to as espionage…
    Let me make sure that I have this impression right; you can support espionage occurs between governments but find it deplorably unhealthy despite ample historical evidence that this also occurs between government-private coordination to occur within the borders against the populace as a whole.

    This Army manual does NOT violate the Posse Comitatus Act. Read the statute: http://www.law.cornell.edu/uscode/text/18/1385

    Also, the U.S. Army is not “claiming” authority or power. It is complying with Acts of Congress which require them to prepare for various missions which Congress has authorized their participation through various federal and state executive branch powers.

    Also, Congressional resolutions do NOT have the power of law, but simply express the “sense of Congress,” and that’s only if they are adopted. No presidential signature or veto is relevant since resolutions are NOT law.

    Lastly, the concern you express is real and warranted, but what is violated is the Constitution itself. The Posse Comitatus Act itself is unconstitutional in that it includes the proviso of making an “act of Congress” an exception to the rule, which is itself a prohibition.

    While it is no excuse, Army officers complying with unconstitutional congressional mandates usually do so because they have no personal working knowledge of the Constitution they are sworn to defend, and rely on senior officers and government officials to dictate what is or is not constitutional.

    “Just following orders” wasn’t an excuse at Nuremberg, and shouldn’t be in America.

    Our own ignorance of the “supreme Law of the Land,” and allowing the “laws of war” to be applied on U.S. soil against any person not serving in the land or naval forces, or Militia, when in actual service, is “treason to the Constitution” as defined by the U.S. Supreme Court nearly 200 years ago. (See Cohens v. Virginia 1821).

    These are all “intolerable acts,” just like the 2012 NDAA which violates no fewer than 14 provisions of the U.S. Constitution, including over half the Bill of Rights. (See http://theintolerableacts.org for model legislation to prohibit its implementation in your state).

    I must say, as educated and well written your post may have been, it still does not justify what is currently happening as of today! Vaguely put, it doesn’t matter what you’re a director of… Congrats on the position, however; your position does not dictate that you’re a subject matter expert as to the original topic. The first link you posted does not validate nor detail how the US Army is NOT violating the Posse Comitatus Act. With the new dissemination of ATP 3-39.33, it is now mandated as such. Which is why DH posted the subtle phrase “soon, very soon!” Whether you are out there in the actual public as compared to being a desk jockey, granted your entitlement to an opinion, you may need more research on the true topic of this article before making another uneducated post. At least put yourself in the broad spectrum of understanding the WHOLE situation before posting, and then ending with “Jeff Lewis, National Director, Patriot Coalition.” Your title does not automatically make you a subject matter expert if you cannot understand the situation as a whole. If anything is shows… well, readers already discerned that.

However, much input and information is flowed in from commanding officers. As a service member, yes you have to follow the “lawful” orders you are given. However, the question that need be asked is why are many military commanders being fired from their positions? Even the military can carry a sense of integrity; it is part of our core values. And when integrity tells us to ask the right questions, individuals are deemed a threat for trying to obtain the truth behind an action or statement. Or for saying speaking the truth, on a given topic or unit climate survey. And in the mindset to a Resolution, you are completely wrong. Congressional Resolutions are implied and enforced as a law, or have you been completely oblivious to state, local and yes federal resolutions that are ENFORCED?! Many resolutions are enforced AS LAWS before being passed into law. There are too many to count on my limbs of laws in US history that begun as resolutions and enforced as such. Many people are oblivious as to what really goes on around them with simple common sense and logical approach’s to understand the truths behind them.

    Vaguely put… This is America! And when the people finally wake up, all of our political leaders will be expunged. That is why congress passes resolutions and introduces bills into laws via you know who. The Constitution is being re-written to give them power. And DH put it best, firing on unarmed protestors not only violates Posse Comitatus, it lines up with the most despotic acts in history! Remember this, and to all who view this post, it was best said in a published courtroom case involving an off topic subject of legal gun ownership. In which the man won. When asked a question on the right to conceal and carry, and to own a hunting rifle as a military veteran, his response was this “I accomplished all the necessary documents needed to legally obtain this hunting rifle and hand gun, why is it that I feel you are trying to get me to do what you want? Panel, you are the ones who work for me! The people voted you into office as a public servant, as well as other political members into office all the way on up… you work for me; you work for the American people. Not the other way around!” It’s only a matter of time before WE THE PEOPLE realize this.

    You sir, are dead wrong. I, in encouraging my sons to join the military still hold that it was exactly the right thing to do and for the right reasons. My wife and I took the time to make sure that all of our children both knew and understood the constitutions both for the United States and for our state.

    Though one son decided against the military our other son, now a Sergeant in the U.S. Army obviously decided to enlist.

    Now we can be sure that Fort Benning has at least one soldier that not only understand the oath sworn upon enlistment, but also knows just exactly what he swore to protect and defend.
